Terms of use

Agreement

These terms are an agreement between you and Le 1er Crew LLC for your use of burgundyatlas.com and the Burgundy Atlas app for iPhone. By using Burgundy Atlas, you agree to them and to our privacy policy. If you don’t agree, please don’t use the service.

Who can use it

You must be at least 18 years old and of legal drinking age where you live. If you use Burgundy Atlas for an organization, you confirm you can accept these terms for it.

The service

Burgundy Atlas is an interactive atlas of Burgundy’s wine places. It shows mapped boundaries, modeled terrain, sources, and catalog references for exploring and learning. It is free to use today; if we ever add paid features, we’ll show their terms before you buy.

We improve the Atlas often, so features may change, pause, or end. Beta versions distributed through TestFlight may be incomplete or unstable. We don’t promise the service will always be available or free of errors.

Your account

The iPhone app uses Sign in with Apple. Keep your Apple account secure; you are responsible for activity under your Burgundy Atlas account. You can delete your account in the app at any time under My Atlas › Settings › Delete account.

Your content

Your saved places, tasting maps, profile, and messages remain yours. You give us a worldwide, non-exclusive, royalty-free license to store, process, and display them only as needed to run the service for you, including showing a tasting map to the people you share it with. This license ends when you delete the content or your account, except where we must keep information by law.

Don’t add content that you don’t have the right to share, that is unlawful, or that infringes someone else’s rights. If you send us feedback or suggestions, we may use them without owing you anything.

Acceptable use

Please don’t:

  • break the law, or use the Atlas to harm, harass, or mislead people;
  • access accounts, data, or systems that aren’t yours, or test, probe, or bypass our security;
  • copy, scrape, or download the service or its data at scale by automated means, or use it to build a competing dataset;
  • overload or interfere with the service, including through its APIs;
  • present Atlas maps as legal, official, or ownership records, or suggest that we or any source endorse you.

Information, not advice

Burgundy Atlas is not legal, cadastral, regulatory, tax, investment, or purchasing advice. Maps, counts, and modeled views may be incomplete or out of date. The map is not legally opposable: check the current record with the issuing authority before relying on it for any decision.

A mapped boundary, an overlap, or a catalog reference does not establish ownership, leasing, farming, planting, grape supply, bottling, production, or bottle origin. Modeled terrain and sun views are representations, not measurements of vine conditions or quality. Wine and producer names and label images appear as reference information; their owners haven’t endorsed Burgundy Atlas, and we haven’t endorsed them.

Intellectual property

The Burgundy Atlas and Wine Atlas names, wordmarks, app icon, design, software, and original content belong to Le 1er Crew LLC and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the service for your own non-commercial purposes under these terms.

Third-party data stays under its own licenses and is credited in the service. It includes land records from the French cadastre (Etalab), wine designations from INAO, elevation and imagery from IGN, map data © OpenStreetMap contributors served by OpenFreeMap, terrain from Mapterhorn, geology from BRGM and DREAL, soil context from INRAE and GIS Sol, weather from Météo-France, label filings from the US Alcohol and Tobacco Tax and Trade Bureau, and a licensed wine catalog. Trademarks shown in label images belong to their owners.

Third-party services

The Atlas links to and relies on services we don’t control, including Apple, Google, TestFlight, Instagram, and map providers. Their own terms and privacy policies apply, and we aren’t responsible for them.

Apple App Store terms

If you got the app from Apple’s App Store or TestFlight:

  • these terms are between you and Le 1er Crew LLC, not Apple, and we, not Apple, are responsible for the app and its content;
  • your license is limited to using the app on Apple devices you own or control, as the App Store Terms of Service allow;
  • Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price, if any; Apple has no other warranty obligation for the app;
  • we, not Apple, are responsible for any claims about the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims;
  • you confirm you are not in a country subject to a US government embargo or designated as supporting terrorism, and not on a US government list of prohibited or restricted parties;
  • you must also follow any applicable third-party terms, such as your wireless carrier’s; and
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers

To the fullest extent the law allows, Burgundy Atlas is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some places don’t allow these exclusions, so some may not apply to you.

Limitation of liability

To the fullest extent the law allows, Le 1er Crew LLC won’t be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Burgundy Atlas. Our total liability for any claim about the service is limited to US$100. Nothing in these terms limits liability that the law doesn’t allow us to limit, such as for fraud, gross negligence, or death or personal injury caused by negligence.

Indemnity

If you use the service in breach of these terms or the law, you agree to cover the reasonable costs we incur from resulting claims, to the extent the law allows. This doesn’t apply to consumers where local law prohibits it.

Suspension and termination

You can stop using Burgundy Atlas at any time and delete your account in the app. We may suspend or end access if you seriously or repeatedly break these terms, if the law requires it, or to protect the service or other people. Where we can, we’ll tell you why. Sections that by their nature should continue, such as disclaimers and limits of liability, continue after termination.

Changes

We may update these terms. We’ll post the new version here with its date, and give notice in the app or on the site before significant changes take effect. If you keep using Burgundy Atlas after that, the new terms apply.

Governing law and disputes

These terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-laws rules, and disputes will be heard in the state or federal courts in Cook County, Illinois. If you are a consumer in the European Union, the United Kingdom, or another country that gives you mandatory protections, you keep them, including the right to bring a claim in your local courts. Before filing a claim, please contact us so we can try to resolve it informally.

General

These terms and the privacy policy are the whole agreement between you and us about Burgundy Atlas. If a part is found unenforceable, the rest still applies. If we don’t enforce a right, we haven’t waived it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets.
